No COVID vaccines required for Wayne County businesses, as SCOTUS strikes down Biden’s mandate

Wayne County employers — including Wayne County Public Schools — will no longer be required to mandate COVID-19 vaccines for their employees, as the Supreme Court struck down President Joe Biden’s vaccine or testing requirement Thursday.

Private businesses, states and local governments could still require vaccines, but the High Court found that the Biden Administration’s argument that the Occupational Safety and Health Administration had the authority to put the requirement into place without approval from Congress was an overreach.

The court did, however, allow to take effect the Department of Health and Human Services’ vaccine policy which requires the vaccine for certain health care workers at hospitals, nursing homes and other facilities that participate in Medicare and Medicaid programs — a mandate that impacts some 10 million U.S. health care workers.
